Significant reports and research relevant to procedural fairness
The publications listed on this page are from bodies outside the criminal justice system and provide research, analysis and commentary relevant to the issues examined on this site.
The written submissions made by the Law Society of Scotland and the Faculty of Advocates as interveners in the Supreme Court proceedings set out in detail the legal profession's analysis of how sections 274 and 275 had been applied and why that application raised serious fair trial concerns. These submissions are significant primary sources for understanding the legal arguments that ultimately persuaded the Supreme Court to intervene.
The SCCRC publishes annual reports detailing its caseload, the categories of potential miscarriage it has investigated, and the referrals it has made. These reports provide publicly available data on the volume and nature of potential miscarriages of justice being raised in Scotland.
The Scottish Government's Equally Safe strategy sets out its approach to addressing violence against women and girls. Accused.scot has analysed this document in the context of its implications for the presumption of innocence and the treatment of the accused.
The Inspectorate of Prosecution publishes thematic reports on aspects of COPFS practice. These reports are publicly available and provide an independent assessment of how prosecution practice operates in Scotland.
